In such circumstances we may charge you an additional fee in accordance with our &#8220;Schedule of Additional Charges&#8221; below.<\/p>\n<p style=\"font-weight: 400\"><strong>8&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/strong><strong>Installation<\/strong><\/p>\n<p style=\"font-weight: 400\">8.1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Following a Confirmation Email, we will send you a pre-installation questionnaire to fill out. Once our team verifies the information, we will contact you to schedule the installation date.<\/p>\n<p style=\"font-weight: 400\">8.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;To ensure a smooth installation process, you need to inform us in advance of any potential issues that may prevent us from completing the installation on the scheduled day, such as access problems affecting the property.<\/p>\n<p style=\"font-weight: 400\">8.3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;To complete the installation, we need to ensure that your electrical capacity (main fuse) can handle the additional power requirements of the product. If the capacity is insufficient, we may need to de-rate the product or put the installation on hold until your electricity supplier upgrades the main fuse.<\/p>\n<p style=\"font-weight: 400\">8.4&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;We collaborate with a group of approved third-party installers (\u201c<strong>Partner Installers<\/strong>\u201d), as well as our own in-house installation team to perform the installation.<\/p>\n<p style=\"font-weight: 400\">8.5&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Under specific circumstances, including where you are eligible for an OZEV EV ChargePoint grant or require a bespoke installation or installation services outside of those we regularly provide, we may direct your order to a Partner Installer so that they can conduct your installation. This may happen if your installation is not standard, requires additional works, or if there are no installation slots available with our in-house installers. In such cases, your contract for the installation will be with the Partner Installer on their own terms.<\/p>\n<p style=\"font-weight: 400\">8.6&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;If we direct you to a Partner Installer after you have placed your order with us:<\/p>\n<p style=\"font-weight: 400\">8.6.1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;the Partner Installer who receives your order will contact you to arrange an installation date, visit your property to perform the installation, and deliver any accessories (if not already sent via post).<\/p>\n<p style=\"font-weight: 400\">8.6.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;the Partner Installer will also request that you complete any documentation necessary to claim the OZEV EV ChargePoint grant on your behalf if you have applied it to your order.<\/p>\n<p style=\"font-weight: 400\">8.7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The area where the products are to be installed must be cleared by you and made ready for the installation on the agreed date of the installation. Where you fail to clear the area and it is necessary for us to do this, you shall pay our adequate charges for this.<\/p>\n<p style=\"font-weight: 400\">8.8&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;You agree to give access to the premises to us, our Partner Installers and all related staff at all reasonable times so that we may complete the installation.<\/p>\n<p style=\"font-weight: 400\">8.9&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;We shall not:<\/p>\n<p style=\"font-weight: 400\">8.9.1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;carry out any structural alteration or building work;<\/p>\n<p style=\"font-weight: 400\">8.9.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;be responsible for and will not undertake any wiring, electrical, plumbing or heating work unless specifically agreed otherwise in writing;<\/p>\n<p style=\"font-weight: 400\">8.9.3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;be responsible for the safety of all materials left on site and part completed installation as this shall be your responsibility; and<\/p>\n<p style=\"font-weight: 400\">8.9.4&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;unless expressly agreed otherwise by us in writing, undertake any decorating work or be responsible for any damage caused to plastering, tiling or decorations.<\/p>\n<p style=\"font-weight: 400\">8.10&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Upon completion of installation, we will send you an installation confirmation email and register the installation date on our server for warranty activation purposes.<\/p>\n<p><strong>9&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Right to cancel<\/strong><\/p>\n<p style=\"font-weight: 400\">9.1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;You&nbsp;have the right to cancel this contract within 14 days without giving any reason.<\/p>\n<p style=\"font-weight: 400\">9.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Unless requested by you during the installation, we won&#8217;t schedule your installation or provide installation services during the 14-day cooling off period.<\/p>\n<p style=\"font-weight: 400\">9.3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;You agree that we can, at your request, start work before the end of the cooling off period. Where you ask us to do this, you agree that we can charge you for any goods delivered or services carried out by us up to the point you notify us that you wish to terminate this agreement.<\/p>\n<p style=\"font-weight: 400\">9.4&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Subject to&nbsp;9.3, the cancellation period will expire after 14 days from the day on which&nbsp;you&nbsp;acquire, or a third party other than the carrier and indicated by&nbsp;you&nbsp;acquires, physical possession of&nbsp;the products.<\/p>\n<p style=\"font-weight: 400\">9.5&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;To exercise the right to cancel,&nbsp;you&nbsp;must inform&nbsp;us&nbsp;of&nbsp;your&nbsp;decision to cancel this contract by a clear statement (e.g.&nbsp;a letter sent by post or email) using the contact details at the top of this page.&nbsp;You&nbsp;may use the model cancellation form available below, but it is not obligatory.<\/p>\n<p style=\"font-weight: 400\">9.6&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;To meet the cancellation deadline, it is sufficient for&nbsp;you&nbsp;to send&nbsp;your&nbsp;communication concerning&nbsp;your&nbsp;exercise of the right to cancel before the cancellation period has expired.<\/p>\n<p style=\"font-weight: 400\">9.7&nbsp;<span style=\"font-style: inherit;font-weight: inherit\">If you purchased your charger through the Humax website, you have the right to cancel your purchase <\/span><strong data-start=\"1010\" data-end=\"1066\" style=\"font-style: inherit\">within 14 days of the date the charger was delivered<\/strong><span style=\"font-style: inherit;font-weight: inherit\"> (the date of arrival), subject to our Returns Policy and Terms &amp; Conditions.<\/span><\/p>\n<p data-start=\"1145\" data-end=\"1164\"><strong data-start=\"1145\" data-end=\"1164\">Faulty product?:&nbsp;&nbsp;<\/strong><span style=\"font-style: inherit;font-weight: inherit\">If your charger develops a fault <\/span><strong data-start=\"1199\" data-end=\"1246\" style=\"font-style: inherit\">within 30 days of the date it was delivered<\/strong><span style=\"font-style: inherit;font-weight: inherit\">, you may be entitled to a repair, replacement or refund in accordance with your statutory rights and our Terms &amp; Conditions.<\/span><\/p>\n<p data-start=\"1373\" data-end=\"1397\"><strong data-start=\"1373\" data-end=\"1397\">Installation charges :&nbsp;<\/strong><span style=\"font-style: inherit;font-weight: inherit\">If you purchased an installation service along with the charger, <\/span><strong data-start=\"1467\" data-end=\"1563\" style=\"font-style: inherit\">the installation charge is generally not refundable once the installation has been completed<\/strong><span style=\"font-style: inherit;font-weight: inherit\">, unless the installation service was not carried out with reasonable care and skill. This does not affect your statutory rights.<\/span><\/p>\n<p data-start=\"1694\" data-end=\"1875\">This policy applies <strong data-start=\"1714\" data-end=\"1783\">only to installation services purchased through the Humax website<\/strong> and does not apply to installation arrangements made directly with a third-party installer.<\/p>\n<p data-start=\"501\" data-end=\"555\"><strong style=\"font-style: inherit\">10&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Effects of cancellation<\/strong><\/p>\n<p style=\"font-weight: 400\">10.1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;If&nbsp;you&nbsp;cancel this contract before installation,&nbsp;we&nbsp;will reimburse to&nbsp;you&nbsp;all payments received from&nbsp;you, including the costs of delivery (except for the supplementary costs arising if&nbsp;you&nbsp;chose a type of delivery other than the least expensive type of standard delivery offered by&nbsp;us).<\/p>\n<p style=\"font-weight: 400\">10.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;We&nbsp;may make a deduction from the reimbursement for loss in value of any product supplied, if the loss is the result of unnecessary handling by&nbsp;you.<\/p>\n<p style=\"font-weight: 400\">10.3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Subject to 10.1 and 10.4, we&nbsp;will make the reimbursement without undue delay, and not later than:<\/p>\n<p style=\"font-weight: 400\">10.3.1&nbsp;&nbsp;&nbsp;&nbsp;14 days after the day&nbsp;we&nbsp;received back from&nbsp;you&nbsp;any product supplied; or<\/p>\n<p style=\"font-weight: 400\">10.3.2&nbsp;&nbsp;&nbsp;&nbsp;(if&nbsp;earlier) 14 days after the day&nbsp;you&nbsp;provide evidence that&nbsp;you&nbsp;have returned the product; or<\/p>\n<p style=\"font-weight: 400\">10.3.3&nbsp;&nbsp;&nbsp;&nbsp;if there were no product supplied, 14 days after the day on which&nbsp;we&nbsp;are informed about&nbsp;your&nbsp;decision to cancel this contract.<\/p>\n<p style=\"font-weight: 400\">10.4&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;We&nbsp;will make the reimbursement using the same means of payment as&nbsp;you&nbsp;used for the initial transaction, unless&nbsp;you&nbsp;have expressly agreed otherwise; in any event,&nbsp;you&nbsp;will not incur any fees as a result of the reimbursement.<\/p>\n<p style=\"font-weight: 400\">10.5&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;If&nbsp;you&nbsp;have received the product:<\/p>\n<p style=\"font-weight: 400\">10.5.1&nbsp;&nbsp;&nbsp;&nbsp;you shall send back the product without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. If you purchased the product from a third party, our warranty only applies to problems with the product itself and not to issues arising from the installation. Please see clause&nbsp;13.5&nbsp;and&nbsp;13.6&nbsp;below for more information on what our warranty does not cover.<\/p>\n<p style=\"font-weight: 400\">13.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The warranty period starts on the date of installation and only applies to products installed in the UK. If you notice any fault or defect, please report it to us promptly via&nbsp;<em><u>uk.support@humaxcharging.com<\/u>&nbsp;<\/em>and include the serial number, installation date, and a brief description of the issue.<\/p>\n<p style=\"font-weight: 400\">13.3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The warranty period for each product will begin from the date of installation if the installation is completed within two (2) months of the purchase date and the installation date is registered on the Humax server (registration occurs when Humax sends the customer an installation confirmation email and the installation date is recorded on our server). If the installation takes place later than two (2) months after the purchase date, the warranty period will instead start from the purchase date.<\/p>\n<p style=\"font-weight: 400\">13.4&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Our technical team will assess the problem and contact you for further details, and if necessary, schedule a service visit. We reserve the right to decide whether to repair or replace the product or any faulty parts or installation, using new or reconditioned equipment. Alternatively, we may replace the product with a newer version.<\/p>\n<p style=\"font-weight: 400\">13.5&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;If you need to reschedule the service visit, please notify us at least two working days in advance. Failure to provide adequate notice or access to the product may result in an additional fee as per our &#8220;Schedule of Additional Charges&#8221; below. The repair or replacement of the product or parts under warranty does not extend the original warranty period.<\/p>\n<p style=\"font-weight: 400\">13.6&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Our Warranty does not cover normal ageing, accidental damage, and wear-and-tear (such as discoloration, normal corrosion\/oxidation) or faults arising from abnormal usage or environmental conditions (such as extreme adverse weather, fire, wind or water damage or other natural disasters) are not covered by our warranty.<\/p>\n<p style=\"font-weight: 400\">13.7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The warranty will become void if:<\/p>\n<p style=\"font-weight: 400\">13.7.1&nbsp;&nbsp;&nbsp;&nbsp;the product is opened, moved, modified, tampered with or repaired by someone other than a Humax authorised electrician;<\/p>\n<p style=\"font-weight: 400\">13.7.2&nbsp;&nbsp;&nbsp;&nbsp;the product is used in a manner that does not comply with the relevant product User Guide or other user or installation instructions issued by us (including storage, installation, use or maintenance);<\/p>\n<p style=\"font-weight: 400\">13.7.3&nbsp;&nbsp;&nbsp;&nbsp;the product is used with any connected equipment (such as a charging cable) that is not supplied by us or recommended for use by us with a product; or<\/p>\n<p style=\"font-weight: 400\">13.7.4&nbsp;&nbsp;&nbsp;&nbsp;the product is stored in an unsuitable location.<\/p>\n<p style=\"font-weight: 400\">13.8&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;In the case of faulty products being repaired or replaced by us, we may return them to our laboratory for assessment. If the fault is found to have arisen due to any reason not covered by our warranty, we reserve the right to recover the repair or replacement costs from you.<\/p>\n<p style=\"font-weight: 400\">13.9&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;If you did not purchase your product directly from us, our warranty only covers faults arising with the product itself, and not with the installation. If you suspect a fault with the product, please ensure the product is connected to Wi-Fi to enable us to run remote diagnostic tests to confirm the fault&#8217;s nature. Then, contact us using the details provided above. If the fault is with the installation, you should contact the person from whom you purchased the product.<\/p>\n<p><strong>14&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Limitation on our liability<\/strong><\/p>\n<p style=\"font-weight: 400\">14.1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;We are responsible to you for any direct and foreseeable loss and damage which we cause if we breach these terms or we are negligent.<\/p>\n<p style=\"font-weight: 400\">14.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Except for any legal responsibility that&nbsp;we&nbsp;cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of&nbsp;your&nbsp;personal information,&nbsp;we&nbsp;are not legally responsible for any:<\/p>\n<p style=\"font-weight: 400\">14.2.1&nbsp;&nbsp;&nbsp;&nbsp;losses that were not foreseeable to&nbsp;you&nbsp;and&nbsp;us&nbsp;when the contract was formed;<\/p>\n<p style=\"font-weight: 400\">14.2.2&nbsp;&nbsp;&nbsp;&nbsp;losses that were not caused by any breach on&nbsp;our&nbsp;part;<\/p>\n<p style=\"font-weight: 400\">14.2.3&nbsp;&nbsp;&nbsp;&nbsp;business losses; or<\/p>\n<p style=\"font-weight: 400\">14.2.4&nbsp;&nbsp;&nbsp;&nbsp;losses to non-consumers.<\/p>\n<p><strong><a><\/a>15&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Other information<\/strong><\/p>\n<p style=\"font-weight: 400\">15.1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;No one other than a party to this contract has any right to enforce any term of this contract.<\/p>\n<p style=\"font-weight: 400\">15.2&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;We may transfer, subcontract, assign or novate any or all of our rights (including the right to recover payments under our contract with you) or obligations under this contract to someone else without your consent. This will not affect your rights under these terms or under our warranty.<\/p>\n<p style=\"font-weight: 400\">15.3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;You may not transfer our contract with you or your rights under it without first getting our written consent.<\/p>\n<p style=\"font-weight: 400\">15.4&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;If you breach these terms and we do nothing or delay taking action, we will still be entitled to take action to enforce this breach or a similar or subsequent breach of the contract with you.<\/p>\n<p style=\"font-weight: 400\">15.5&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Each of the paragraphs in these terms operate separately.
